Terms and conditions of sale

1. Seller and scope

These terms govern photographic print sales by Tonio Bessa, French sole trader (EI), 118 rue de Paris, 94220 Charenton-le-Pont, France. SIRET: 882 682 586 00012. VAT not applicable under Article 293 B of the French Tax Code. Contact: bessa.tonio@gmail.com.

They apply to consumer customers. The applicable version is the one presented when the order is placed.

2. Prints, editions and prices

The photograph, size, framing, price and delivery charge are shown before payment. Each photograph is signed and limited to ten copies across all sizes and finishes for that print.

Prices are in euros. Delivery costs €30 to France, €50 to Europe and €75 outside Europe. Import duties and taxes outside the EU are payable by the recipient.

3. Order and payment

Customers check the print, size, framing, destination and total before confirming. Secure payment is processed by Stripe. The order is formed after payment confirmation and an electronic acknowledgement is sent.

Inventory is updated after payment. At zero, the print is marked sold out and purchasing is disabled. If an item exceptionally becomes unavailable after payment, the customer is notified and fully refunded.

4. Preparation and delivery

An unframed print is dispatched within seven business days after payment confirmation. A framed print is dispatched within fifteen business days.

From dispatch, transport takes four business days to France, seven to Europe and ten outside Europe. UPS is used in Europe and internationally; UPS or La Poste is used in France.

Times may be extended by force majeure or an unforeseeable external event. Customers retain their statutory cancellation and refund rights in the event of delay.

5. Receipt and damage

Customers should inspect the parcel and print on receipt. Damage should be reported with photographs of the parcel, shipping label and print within 48 hours. This helps the claim and does not limit statutory rights.

6. Withdrawal

Consumers have fourteen days from the day after delivery to notify withdrawal without giving a reason. The prints are not personalised, so withdrawal applies even where production begins after ordering.

Withdrawal may be notified clearly to bessa.tonio@gmail.com, stating the order number, name, address and print. Suggested wording: “I hereby give notice that I withdraw from the contract for the following goods, ordered on […], received on […], consumer’s name and address, date and signature if submitted on paper.”

7. Returns and refunds

After notice, the print must be returned within fourteen days, properly protected and in its original condition, to: Tonio Bessa, 118 rue de Paris, 94220 Charenton-le-Pont, France.

For a change of mind, direct return costs are paid by the customer. The seller pays them where the item is faulty, damaged or incorrect.

The price and standard delivery cost are refunded to the original payment method within fourteen days of notice. Reimbursement may be withheld until the goods or proof of dispatch are received.

8. Statutory guarantees

French statutory conformity and hidden-defect guarantees apply. Contact the seller with the order number and relevant evidence. These rights apply independently of any commercial warranty.

9. Intellectual property

Purchasing transfers ownership of the physical copy only. It does not authorise reproduction, digitisation, adaptation, commercial exhibition or exploitation without prior written permission.

10. Complaints and mediation

Complaints must first be sent in writing to bessa.tonio@gmail.com. If no amicable solution is reached, consumers may use the Centre de Médiation et d’Arbitrage de Paris — CMAP, Service Médiation de la consommation, 39 avenue Franklin D. Roosevelt, 75008 Paris, France — consommation@cmap.fr — cmap.fr/saisir-cmap-mediation-consommation/.

Mediation may be requested after a prior written complaint and within the statutory time limit.

11. Applicable law

French law applies without depriving consumers of more protective mandatory rules in their country of residence. Courts are determined by the applicable statutory jurisdiction rules.
